Michael Dreiling, in addition to amending simple traffic violations, has provided legal representation to many clients facing their first or second DUI/DWI charges. In the last year, Mr. Dreiling has represented two individuals facing felony DUI charges in Missouri. Recently, Mr. Dreiling won a motion to supress the blood alcohol content breath test given on an Intoxilyzer 8000 as the proper Kansas Department of Health and Environment protocols were not followed by the law enforcement officers.
Additionally, Mr. Dreiling obtained an aquital after a DUI trial for an individual alleged to have ingested crystal meth when it was shown that the individual obeyed all traffic laws while driving the vehicle thereby not failing to operate the vehicle in a safe manner pursuant to K.S.A. 8-1567.
Mr. Dreiling also successfully obtained an acquittal for a minor who was charged with minor in possession of alcohol when it was established that even though she was in a vehicle that contained a bottle of alcohol in it, the State did not prove that the minor had knowledge of the alcohol or the requisite intent to control the alcohol.
